My application is a voluntary request to accompany the Peter Lebeck Chapter of the Ancient and Honorable Order of E Clampus Vitus, Inc.® (hereinafter ECV®), in support of its purpose of erecting and dedicating various plaques and/or monuments commemorating major and lesser personalities, places and events in California history.
I am aware that the meetings of ECV® often occur in the wilderness, and that driving from my point of departure to said meeting (hereinafter Clampsite), my participation in the various activities at said Clampsite and driving back to my point of departure are potentially dangerous and hazardous activities. I am voluntarily participating in these activities with the knowledge of the dangers involved, and hereby agree to accept any and all risks of injury and death.
BY SUBMITTING MY APPLICATION I AM ACKNOWLEDGING THAT I UNDERSTAND THESE RISKS.
As consideration for being permitted by ECV® to participate in these activities, I hereby agree that I, my assignees, heirs, distributes, guardians, and legal representatives, hereby release from any and all liability and will not make a claim against, sue, obtain a judgment against, and/or attach the property of Peter Lebeck Chapter ECV®, E Clampus Vitus, Inc.®, and/or the owners of the Clampsite property, or against any officers or members of the Peter Lebeck Chapter and ECV® for injury or damage resulting from negligence or other negligent acts or omissions, howsoever caused, including, but not limited to, the acts or omissions of negligence by any ECV® member including the sole acts or omissions of negligence of these persons as a result of my participation in, or travel to and from the Clampsite.
I hereby release the Peter Lebeck Chapter of E Clampus Vitus, Inc.®, E Clampus Vitus, Inc.® and the owners of the Clampsite property, as well as any officers or members of Peter Lebeck Chapter ECV®, and E Clampus Vitus, Inc.®, from all actions, claims or demands that I, my assignees, heirs, distributees, guardians, and legal representatives now have or may have for injury or damage resulting from my above-described participation at the Clampsite. FURTHERMORE if I am making application to join Peter Lebeck Chapter ECV®, as a "Poor Blind Candidate," intent upon participating in the chapter's initiation process and ceremony, I promise to make full disclosure of any physical or medical conditions that might prevent me from full participation in the initiation or pose risk of harm from moderate physical activity, no later than my first meeting with the functionary in charge of the initiation. Failure to do so will result in my expulsion without refund, along with that of my sponsor.
KNOWING AND VOLUNTARY EXECUTION OF RELEASE OF LIABILITY AND ALL CLAIMS I HAVE CAREFULLY READ THIS AGREEMENT, AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A LIFELONG CONTRACT BETWEEN ME AND THE PETER LEBECK CHAPTER OF THE ANCIENT AND HONORABLE ORDER OF E CLAMPUS VITUS®, ITS OFFICERS AND MEMBERS AND I SIGN IT OF MY OWN FREE WILL, HAVING MY FULL MENTAL FACULTIES AND NOT BEING UNDER THE INFLUENCE OF ANY INTOXICANT. |
